We have written our terms and conditions in straightforward language so that you may easily understand where you stand when making a purchase from employmentdocuments.com. These terms and conditions relate to purchases made at www.employmentdocuments.com (“the website”).

By agreeing to these terms and conditions, you are agreeing with all our terms and conditions, as they stand and without modification. If you do not agree to the terms and conditions then we would ask that you leave the website immediately and not proceed with any purchase that you may have been considering.

Trading Name

Employmentdocuments.com is a trading name of Employment Personnel Advisory Services Limited ("EPAS"), a company registered in the UK – number 05609038. Registered office: 45 Basepoint Business Centre, Oakfield Close, Tewkesbury, Gloucestershire, GL20 8SA.

Refunds, Cancellations & Distance Selling Regulations

We intend all documents listed on the website to be sold to businesses and as such, Distance Selling Regulations do not apply to business sales.

Should you be a consumer adapting a document for personal use, then be aware that as our documents are all electronic, in accordance with regulation 13 of the Consumer Protection (Distance Selling) Regulations 2000, no automatic right of refund or cancellation will exist after a document has been purchased.

If a document is deemed to be faulty (in the case of electronic documents, a corrupt file, etc.) then you should make EPAS aware within 24 hours of purchase by emailing support@employmentdocuments.com.

We’re passionate about customer care, so we will do our best to rectify the situation and will endeavour to send a new document within 48 hours. In all cases we will offer an exchange for the identical document or a credit note for use on the website. Only at our absolute discretion will you be entitled to a refund.

About the Product

Whilst all the documents that are available for download on the website are drafted by HR Professionals and subsequently checked by employment law solicitors, by the nature of the content we are unable to offer any guarantee that the documents are up to date at all times.

We explicitly advise that before using any document downloaded here, that you have them checked by your own solicitors for peace of mind, as we will not be held liable for any damages however so arising from the use of these documents. The purpose of downloading template documents is to avoid the high costs associated with having these documents drafted, there is still a cost to have them checked. Should you choose not to have them verified, you do so at your own risk.

These documents are drafted with reference to and in order to comply with the laws of England & Wales and no other jurisdiction.

Legal Advice

Downloading and using these documents does not, and never will constitute EPAS offering legal advice. In addition, the transmission and/or downloading and sending of these documents does not and never will create a client/solicitor relationship between EPAS and the person downloading the documents (or the business they are downloading the documents on behalf of).

Copyright

EPAS own the copyright on all the documents listed on the website. Please don’t attempt to modify them in any way so you can claim that they are your own and therefore claim the copyright. If your company is part of a group of companies, you can only use the documents in the particular company that purchased them. Contact us and we can offer additional licenses at reduced fees.

As we do hold the copyright to the documents, we politely ask that you leave the copyright notice on them (it’s in the small writing in the footer). Removing this will breach the copyright.

You may not transfer ownership of any of the documents that you have bought to any other organisation to enable them to breach this copyright clause. You may not rent or lease any document to anyone else.

Use of Employmentdocuments.com Service

It’s up to you to make sure that the information you enter onto the website is accurate, email addresses in particular, as these will be used to send your document(s). If you enter the wrong information, we reserve to right to not offer a refund, though we will help as much as possible to resolve any issues you may have.

Use of Documents

If you purchase a document from the website, then it may be used by your personally (including your immediate family) or in your business. We need to be explicit that the document should not be re-sold, re-published, re-distributed (except within the business if the nature of the document requires such). It is not acceptable to copy and paste, disassemble, adapt or vary any section of any document for the purposes of re-sale.

Document Updates

Whilst we will use our best endeavors to notify you of any updates to policies and procedures, we stress that it is your responsibility to make sure the document is up to date at all times and continues to apply to the relevant laws of England and Wales.

Disclaimer

The information and documents available on the Website are provided on an "as is" basis without any representations or endorsements made and without any warranty of any kind whether express or implied, including but not limited to implied warranties of fitness for purpose, merchantability and accuracy.

Whilst we do make statements about the documents and employment law in general throughout the site, we must stress that you should not constitute this as advice of any sort. Essentially, by acquiring the document you intend to make use of it in the proper way on the basis of receiving legal advise as to its application and adaptation for your particular business.

If you choose to make amendments to the document we can’t be held liable for any such amendments. If you seek legal advice on the document, then the liability for the document will become that of the party from which you sought advice.

By using the Website you agree that in no circumstance shall EPAS be liable for any indirect, incidental, special or consequential damages, including, but not limited to, loss of business or profits or any other financial loss, arising out of or in any way connected with the use of the Website or the documents, under any law or on any basis whatsoever whether contractual or otherwise, except in relation to death or personal injury for which no limit shall apply.

In addition you agree that if, for any reason, EPAS is liable for any damages, other than those for death or personal injury, the total liability of EPAS shall be limited to the amount of the document purchased plus an additional amount of £150.

Alteration of Terms and Conditions

If you make a purchase form the website, then the terms upon which you agree will be the terms by which you are bound for that purchase. We reserve the right to change our terms and conditions at any time. Any revised terms and conditions will apply to future purchases. That is to say, you may have one document bound by one set of terms and conditions, and a different document bound by another set.

Complaints

We’re passionate about customer care and we truly hope that you never have cause to complain about our services. If you do feel you need to however, you should contact us by email at support@employmentdocuments.com. We aim to acknowledge receipt of your complaint within 15 business hours and aim to respond fully within 7 working days, depending on the nature of the complaint.

Entire Agreement

This Agreement constitutes the entire agreement between us concerning its subject matter.

Terminating the agreement

Whilst we believe this agreement is valid and enforceable, if any clause is deemed not to be such, that clause shall be removed but the remaining parts of the agreement shall remain in force.

General

Your statutory rights are not affected.

Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
